Medicare & Medigap Basics
When can you enroll in Medigap in South Dakota?
Last reviewed: · Big Sioux Benefits Data Desk
You can apply for Medigap in South Dakota at any time of year, but insurers are required to accept you only during your one-time 6-month Medigap open enrollment period, which starts the first month you are both 65 or older and enrolled in Medicare Part B, or when a federal guaranteed-issue right applies (source: Medicare.gov). Outside those windows, South Dakota carriers may ask health questions and can decline or surcharge you.
The qualifier that surprises people: this window is tied to Part B, not to your 65th birthday. If you keep employer coverage past 65 and delay Part B, your Medigap window waits and opens when Part B starts. And unlike the Annual Enrollment Period every fall, which is for Medicare Advantage and Part D, not Medigap, this window does not repeat.
The windows that matter in South Dakota
| Window | Who gets it | What you're guaranteed |
|---|---|---|
| Medigap open enrollment (6 months) | Everyone, starting the first month at 65+ with Part B | Any plan any insurer sells, at standard rates, no health questions |
| Under-65 access (South Dakota rule) | Beneficiaries on Medicare before 65, e.g. through disability | All plans guaranteed-issue; premium capped at the 75-year-old rate; a second full window at 65 |
| Federal guaranteed-issue rights | After qualifying events: plan leaves your area, employer coverage ends, the 12-month Medicare Advantage trial right, and others | Specified plans, no health questions, within the event's deadline (usually 63 days) |
| Everything else | Anyone applying outside the above | Nothing: medical underwriting applies; approval isn't guaranteed |
The under-65 rule is a genuine South Dakota advantage: federal law doesn't require it, but South Dakota is listed among the states making every Medigap plan guaranteed-issue for under-65 beneficiaries with the 75-year-old rate cap (medicareresources.org, updated March 6, 2026; healthinsurance.org, June 2026). What South Dakota does not have is a birthday switching rule, covered here, which makes the first plan choice weightier than in states that do. The full state picture is in our South Dakota Medigap guide.

Is the fall Annual Enrollment Period a Medigap enrollment window?
No, October 15 to December 7 is for Medicare Advantage and Part D changes. Medigap has no annual re-opening; your rights come from the one-time 6-month Part B window, a guaranteed-issue event, or (under 65 in South Dakota) the state's access rule. You can still apply in the fall, but underwriting rules apply as they would any other day.
What happens if I apply for Medigap outside my open enrollment window?
The carrier can medically underwrite: review your health history, charge more, or decline the application, unless a federal guaranteed-issue right applies, such as your Medicare Advantage plan leaving your county or losing employer coverage. Guaranteed-issue events generally give you 63 days to act (Medicare.gov).
